Organization of
Tri-Community Water
& Sewage Authority
An Ordinance organizing an Authority under the Municipality Authorities Act of 1945 for the purpose of Constructing or otherwise providing facilities to furnish, maintain, and administer a water distribution system and sewage and waste collection and treatment facilities in Fairfield Township and Bolivar Borough, Westmoreland county Pennsylvania, and West Wheatfield Township, Indiana County, Pennsylvania, to be known as the Tri-Community Water and Sewer Authority.
Be it enacted and ordained by the Borough Council of the Borough of Bolivar, and by the Board of supervisors of Fairfield Township, County of Westmoreland and commonwealth of Pennsylvania, and it is ordained and enacted by authority of the same as follows.
Section 1. Joint Authority. It is the joint desire and intention of the municipal authorities of the Borough of Bolivar and the Township of Fairfield, both in the County of Westmoreland, and the Township of West Wheatfield, in the County of Indiana all municipalities of the commonwealth of Pennsylvania, to organize and authority under the "Municipality Authorities Act of 1945" designed as Act 164, approved May 2, 1945, together with all supplements thereof and amendments thereto, for the purpose of exercising and enjoying all the powers of the Act, its supplements or amendments.
Section 2. Name and Authority. The name of the proposed authority is "The Tri-Community Water and Sewer Authority".
Section 3. Articles of Incorporation. The proposed Articles of Incorporation of the Authority is as follows:

In compliance with the Municipality Authorities Act of 1945, its supplements and amendments, the Borough of Bolivar and the Township of Fairfield, both in the County of Westmoreland, and the Township of West Wheatfield in the County of Indiana, all municipalities of the commonwealth of Pennsylvania, pursuant to identical Ordinances duly adopted by the representative municipal authorities of all three municipalities signifying their joint desire and intention to form an Authority, hereby certify:
1. The name of the Authority shall be: "The Tri-Community Water and Sewer Authority."
2. This authority is formed under the Municipality Authorities Act of 1945, its supplements and amendments.
3. No other joint Authority organized under the Municipality Authorities Act of 1945, its supplements or amendments, the Act approved June 28, 1935 P.L. 463 as amended, is in existence in or for the incorporating municipalities named herein.
4. The purpose of the authority is to construct or otherwise provide the facilities necessary to furnish, maintain and administer a water distribution system, as well as the facilities necessary to furnish the collection and treatment of sewage wastes from the incorporating municipalities and from such adjoining political subdivision or areas as may desire the service.
5. The respective names of the incorporating municipalities are:

Section 4. Appointment of Board. The following persons, respectively hereinafter designated as appointees of either the Borough of Bolivar or the Townships of Fairfield or West Wheatfield are hereby appointed members of the Board of the authority, with the following terms of office :

Section 5. Execution of Articles of Incorporation. The Articles of Incorporation of the Authority, in substantially the form set forth in Section 3 of this Ordinance shall be executed on behalf of the Borough of Bolivar by the President of Council, and under its municipal seal attested by the Secretary of the Borough of Bolivar, and on behalf of the Township of Fairfield by the Chairman of the Board of the Township Supervisors, under its municipal seal attested by the Secretary of the Township of Fairfield, and on behalf of the Township of West Wheatfield by the Chairman of the Board of Township Supervisors, under its municipal seal attested by the Secretary of the Township of West Wheatfield, and such officers are hereby authorized, empowered and directed to do all things necessary or appropriate to effect and establish the said Authority, in conformity with the Municipality Authorities Act of 1945, its supplements and amendments.
Section 6. General Welfare. The adoption of this Ordinance is deemed necessary for the benefit and preservation of the public health, peace, comfort and general welfare, and will increase the prosperity of the people of the Borough of Bolivar and the Townships of Fairfield and West Wheatfield.
Section 7. Effective Date. This Ordinance shall become effective upon final passage.
Ordained and enacted into an Ordinance and passed by the Borough of Bolivar, County of Westmoreland and Township of Fairfield, County of Westmoreland and commonwealth of Pennsylvania, this 3rd day of February 1978.
