"Bicycles" on Public
Streets
An Ordinance to Prohibit Operation of Certain Non-Motorized Self-Propelled Devices of Transportation or Conveyance for Amusement, and establishing penalties for any persons who fail or refuse to comply with, the requirements or provisions of this Ordinance. This Ordinance shall take effect immediately.
Be it enacted and ordained by the Borough of Bolivar, Westmoreland County, Pennsylvania, and it is hereby enacted and ordained by the authority of the same as follows:
Article I. Intent. The intent of this Ordinance is to:
a. Promote the general health, welfare, and safety of the community.
b. Minimize risk of accident between operators of motorized vehicles and non-motorized vehicles herein described.
Article II. Definitions.
a. "Bicycle" Any device propelled by human power upon which a person can ride or be conveyed having no more than two tandem wheels.
Article III. Unlawful to operate certain non-motorized vehicles.
It shall be unlawful for any person to ride, operate, or be conveyed upon a sled, skis, skateboard, roller skates, non-motorized riding vehicle or device, excluding bicycles, upon any public road, street or alley within the Borough of Bolivar.
Article IV Penalty
Any person who shall violate provisions of this Ordinance shall, upon conviction thereof, pay a fine to the Borough of Bolivar of not less than five dollars ($5.00) plus costs of prosecution.
Article V. Severability
Should any section, subsection, sentence, clause or phrase of this Ordinance be declared invalid by a covert of competent jurisdiction, such decision shall not affect the validity of the Ordinance in its entirety or any part thereof other than that declared to be invalid.
