RESOLUTION NO 4 OF 2024

A RESOLUTION OF THE BOROUGH OF BOLIVAR, COUNTY OF WESTMORELAND, AND THE COMMONWEALTH OF PENNSYLVANIA FOR ATTORNEY'S FEES TO BE RECOVERED FOR THE COLLECTION OF DELIQUENT MUNICIPAL CLAIMS AND LIENS AS AUTHORIZED PURSUANT TO 53 PS § 7106 AND BOLIVAR BOROUGH ORDINANCE NO 3 OF 2005

WHEREAS, Ordinance No 3 of 2005 establishes a schedule of atorney's fees to be recovered in matters relating to the collection of deliquent accounts or the enforcement of liens.

WHEREAS, Ordinance No 3 of 2005 set the rate at $80 per hour

WHEREAS, Ordinance No 3 of 2005 empowers the Council of Bolivar Borough to revise the rate of the fee by Resolution from time to time.

WHEREAS, the rater has not been amended since 2005, despite general increases in costs and fees in the past 19 years.

WHEREAS, the rate therefore no longer accurately reflects the costs related to the collection of delinquent accounts or the enforcement of liens

Be it RESOLVED that the Borough of Bolivar of Westmoreland County hereby raises the rate of the fee to be assessed or added to any amount or claim related to the collections of delinquent accounts or the enforcement of lines to $125 per hour.
