Ordinance # 046 Licensing and Inspection of Certain types of Amusement Machines


An Ordinance providing for the licensing and inspection of certain types of amusement machines, namely music boxes, juke boxes, victrola's, pinball machines, and any other machine or contrivance whatsoever which operates or plays upon the deposit or payment of a coin, and providing penalties for the operation of said machines without a license.

Be it ordained and enacted by the council of the borough of Bolivar, Westmoreland County, Pennsylvania, and it is hereby enacted by authority of the same:

Section 1. That on the first day of January .D. 1947 and not later than the 5th day of March 1947 the owner or operator of any music box, juke box, victrola, pin ball machine, or any other machine or contrivance whatsoever which operates or plays upon the deposit or payment of a coin, and which is maintained in any restaurant, shop, store, dance hall, saloon, club, or other place of public resort in the borough of Bolivar, shall:

a. File with the Chief burgess a declaration, under oath of the number and character of such machines or contrivances which are maintained in his or her place of business, together with the names of the owners thereof,

b. At the same time, and annually thereafter on or before the first day of December in each year, pay to the said Chief Burgess an annual license fee for the purpose of providing for an inspection, registration, and supervision of the said machines or contrivances, the sum of $15.00 per annum, providing however, with request to any such machines or any other contrivances which are installed, or the operation of which begins after the installation and commencement of operation of said machines or contrivances, and a monthly fee of $1.50 shall be paid until the following first day of January in the next succeeding year.

c. Any owner or operator of such machines, or owner or operator of any such place of public resort who fails to declare and pay the said license fee, as herein provided, shall pay a fine for the violation of this Ordinance in the amount of $25.00 and costs, to be recovered before the Chief Burgess or any Justice of the Peace in the said Borough of Bolivar, in default of which such offender shall be committed to the County Jail for a period of not to excess thirty days.

Amendment on this Ordinance was passed by all members present at meeting held on January 8 1951, reducing assessment on Jute Boxes from $15.00 to $10.00 per year.
