Regulating Opening

and Digging Up

of Streets


Regulating and Governing the Opening or Digging Up of any pavement, street, or alley within the Bolivar Borough and the Regulations for the closing of same and penalty for violation thereof.

Be it enacted and ordained by the Borough of Bolivar and it is hereby enacted and ordained by the authority of the same.

Section 1. It shall be unlawful to dig or open any pavement, street, or alley within the Borough unless application for a permit shall have been made to the burgess, said application to recite the location of the portion of pavement, street, or alley to be opened and the purpose for the opening, together with $2.00 for each permit requested. Permits shall be issued by the Burgess after he is satisfied that the opening is for proper purposes and that applicant has complied with the conditions of this Section, conditioned that the applicant shall restore the payment, street, or alley dug upon opened under said permit, with thirty (30) days following the opening, to as good condition the same was before the opening, and to maintain the same in said good condition for a period of one year. If said surface is not restored as herein above required, and maintained, the Borough of Bolivar may in its discretion restore and maintain the surface and charge said applicant for the actual costs plus a 20% penalty.

Section 2. Any owner, tenant, builder, contractor, architect, workman or other person who shall violate any of the conditions or regulations herein recited, including but not limited to the payment of the fees herein recited, shall upon conviction thereof before the Burgess of the Borough of Bolivar or a Justice of the Peace, be sentenced to pay a fine of not less than $5.00 or more than $100.00 and the costs of suite for each offense, sand in default of the payment of such fine and costs shall be confined in the Westmoreland County Jail for a period not exceeding 10 days, that the payment of said fines shall not release the violation from payment of the required fee.

Section 3. That all Ordinances or Resolutions or parts thereof inconsistent herewith, be and the same are hereby repealed.

Be it enacted and ordained by the Borough of Bolivar and it is hereby enacted and ordained by the authority of the same.

Section 1. It shall be unlawful to dig or open any pavement, street, or alley within the Borough unless application for a permit shall have been made to the Mayor. Said application to recite the location of the portion of pavement, street, or alley to be opened and the purpose for the opening, together with a fee of $5.00 for each opening and $10.00 dollars for each sewage tap, conditional that the applicant shall restore the pavement, or all improved streets dug up or opened under said permit. There shall be no less than 7 inches of concrete to be erected not less than one foot on each side of the opening on solid ground or streets covered with black-top, same shall be applied on tip of cement base finish, and to maintain the same in good condition for a period of one year. If said surface is not restored as wherein required and maintained, the Borough of Bolivar may in its discretion restore and maintain the surface and charge said applicant for the actual costs plus a penalty of 20%.
