Prohibiting running at
Large of Animals
An Ordinance to Prohibit or Regulate the running at large of Animals
Whereas, many complaints have been received by the Bolivar Borough Council, Bolivar Westmoreland County, Pennsylvania, to the effect that animals are running at large, particularly dogs and whereas many strange dogs have been noticed running at large in all sections of the Borough of Bolivar, and some which strays, obviously not fed and uncared for and having the appearance of being sick.
Section 1. Now, therefore, be it ordained and enacted by the Borough of Bolivar, Westmoreland County in a meeting duly convened and it is hereby and enacted by the authority of the same as follows,
Section 2. That from and after the effective date of this Ordinance, it shall be unlawful for animals of any kind and description to be permitted to run at large throughout this Borough.
Section 3. Dogs and cats must be confined on the premises of the owner. when allowed out, the same must be under the control at all times of the owner thereof, dogs are permitted on the streets and alleys of the Borough when on a leash and in the car of the owner.
Section 4. It shall be the duty of the police officers of this Borough and the Dog Catcher to siege and detain any dog or dogs which bear a proper license tag and which are found running at large or upon the property of others than the owners of such dog and unaccompanied by the owner or keeper. Any police officer is hereby authorized and empowered to go upon any premises and enter any building to siege and detain any dog or dogs which have been found running at large unaccompanied by the owner or keep when such police officer or Dog Catcher is in immediate pursuit of any dog or dogs.
Section 5. Where proper complaint or other evidence has verified the fact that a dog is mad, or suffering from rabies, any officer of this Borough or the Dog Catcher is herewith empowered , authorized, and directed to shoot such dog on sight regardless of whether the dog bears a proper license tag.
Section 6. Nothing contained in the provisions of this Ordinance shall be construed by anyone as an abrogation of the dog laws of the State of Pennsylvania.
Section 7. Any person violating or failing or refusing to comply with any of the provisions of this Ordinance, shall upon conviction in a summary proceedings before the Mayor of Bolivar Borough, Westmoreland County, Pennsylvania, be sentenced to pay a fine of not less than $5.00 nor more than $100.00 dollars and costs of prosecution or in lieu thereof, undergo imprisonment not exceeding 30 days.
All fines collected under the provision of this Ordinance shall be paid to the Borough Treasurer.
Section. 8 Any Ordinance or parts of Ordinances conflicting with the provisions of this Ordinance are repealed in so far as the same effects of the provisions of this Ordinance.
